EB-5 visas allow foreign investors to enter the U.S. with a significant financial investment of at least a million dollars into a new commercial enterprise. In addition, EB-5 regulations contain a caveat that allows foreign investors to qualify if they have put forth a $500,000 investment into a low employment area. In certain instances, lower value investments into rural areas outside metropolitan areas can qualify a foreign investor for an EB-5 visa. In addition, the foreign investor must prove that the investment will result in the employment of at least 10 qualified U.S. workers over a two-year period. The investor must also prove that the money came from a legal source and is at “risk”.
